1. Introduction
These terms and conditions govern your use of the MyWebAccess website and services. MyWebAccess is operated by MyVision Oxfordshire, a registered charity (Charity Number: 1140556) and company limited by guarantee (Company Number: 07465300), registered in England and Wales.
By using our services, you agree to be bound by these terms. If you do not agree to these terms, please do not use our services.
2. Definitions
- "We", "us", "our" refers to MyWebAccess and MyVision Oxfordshire
- "You", "your" refers to the person or organisation using our services
- "Services" refers to accessibility audits, reports, and related services
- "Website" refers to mywebaccess.co.uk
- "Portal" refers to the agency portal for managing audits
3. Services
3.1 Accessibility Audits
We provide website accessibility audits that include:
- Manual testing by disabled user testers using assistive technology
- Automated accessibility scans
- Expert analysis and WCAG 2.2 mapping
- Comprehensive PDF reports with remediation guidance
3.2 Scope of Audits
The scope of each audit is agreed before work begins. Audits cover the specific pages and user journeys agreed in the scope document. Additional pages or journeys may incur additional charges.
3.3 Turnaround Time
Standard turnaround is 14 days from kickoff to report delivery. Expedited services may be available on request and may incur additional charges.
4. Partner Programme
Agencies may apply for our partner programme to access discounted rates. Partner status is granted at our discretion and may be withdrawn if:
- Minimum volume requirements are not met
- Payment terms are not adhered to
- These terms are breached
5. Payment Terms
5.1 Pricing
Prices are as quoted at the time of booking. Current pricing is displayed on our website. All prices are in GBP and exclude VAT where applicable.
5.2 Payment
Payment is due within 30 days of invoice date unless otherwise agreed. We accept payment by bank transfer or card.
5.3 Late Payment
We reserve the right to charge interest on overdue payments at 4% above the Bank of England base rate.
6. Your Responsibilities
To enable us to provide our services, you agree to:
- Provide accurate information about your website and requirements
- Ensure we have appropriate access to test the specified pages
- Provide any necessary credentials in a secure manner
- Notify us promptly of any changes to the website during the audit period
- Not make substantial changes to tested pages during the audit period
7. Intellectual Property
7.1 Report Ownership
Upon payment, you receive a licence to use the audit report for your internal purposes and to share with your clients. The underlying methodology and testing processes remain our intellectual property.
7.2 Confidentiality
Audit reports contain confidential information about accessibility issues. You agree not to publicly disclose specific findings without appropriate context and remediation plans.
8. Limitations
8.1 No Guarantee of Compliance
Our audits provide expert assessment against WCAG 2.2 guidelines but do not guarantee legal compliance. Accessibility is an ongoing process and websites may change after audit completion.
8.2 Limitation of Liability
To the maximum extent permitted by law, our total liability for any claim arising from our services shall not exceed the fees paid for the specific audit in question.
8.3 Exclusions
We are not liable for any indirect, consequential, or incidental damages, including but not limited to loss of profits, data, or business opportunities.
9. Cancellation and Refunds
9.1 Cancellation by You
- Cancellation before audit begins: Full refund
- Cancellation after testing starts: Partial refund at our discretion
- Cancellation after report delivery: No refund
9.2 Cancellation by Us
We may cancel or suspend services if you breach these terms, fail to provide necessary access, or for other reasonable business reasons. In such cases, you will receive a refund proportionate to work not yet completed.
10. Portal Terms
Access to the agency portal is subject to the following additional terms:
- You are responsible for maintaining the security of your login credentials
- You must not share access with unauthorised users
- You must notify us immediately of any suspected security breach
- We may suspend access if we detect suspicious activity
11. Data Protection
We process personal data in accordance with our Privacy Policy. By using our services, you acknowledge that you have read and understood our data protection practices.
12. Changes to Terms
We may update these terms from time to time. Material changes will be communicated to registered users. Continued use of our services after changes constitutes acceptance of the new terms.
13. Governing Law
These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
